Chapter 7 bankruptcy rules in Texas
Texas
is the one state that does all the things differently from the rest of the
country but in the case of bankruptcy, it is an exception. Bankruptcy laws are
same nationwide. This is the reason why debtors will not experience any
difference. The area of jurisdiction does not really affect the entire
procedure. In all the states, once you file for chapter 7 bankruptcy, bankruptcy
court will stop all the collection procedures from your creditors. And once the
case proceeds, chapter 7 will help you to discharge all the debts. Your medical
bills and credit card debt will also be discharged by chapter 7. Elimination of
debts remains unaffected by the state. The single slight difference in laws
applied in Texas is in exemption laws. Texas has the most liberal exemption
laws. And only in rare cases debtors do not use their protections.
Debtors
can protect an unlimited amount of property in their home. Now, according to
new bankruptcy laws, the debtors must have lived in the state for at least 3
years 4 months, before claiming such protection which is more than $146, 450.
If you have changed your home in the same state then you are eligible for this
protection. Texas’s exemption laws will be applicable in your case only if you
have been living in the state for more than 2 years. If you have recently moved
from some other state to Texas then laws of your previous state will be
applied. Moving from accommodation to vehicles, if you have a driving license
then you can protect the equity of a car.
